DUI Attorney in Daytona Beach

Since 2000, G. Kipling Miller, Esquire, Daytona Beach DUI Lawyer of Koleilat & Miller has represented more than 1000 people accused with driving under the influence (DUI). DUI carries with it a cumulative punishment system; even one offense can be very detrimental to your ability to drive, while repeated offenses can result in serious jail time, hefty fines, and more. Call Mr. Miller if you have been accused of:

  • A DUI or DWI (driving while intoxicated)
  • Driving under the influence with serious bodily injury
  • Driving under the influence manslaughter

DUI charges can be leveled against you even if you are not intoxicated with alcohol or illegal drugs. Some prescription medications have been to blame for impaired driving.

If this is your first DUI offense, you are looking at the following punishments:

  • Fines
  • Revocation of your driver’s license (up to 1 year)
  • Jail time (up to 6 months)
  • Vehicle impoundment  (10 days)
  • Probation (up to 1 year)
  • Alcohol safety and education class
  • Community service

The case becomes more serious if this is your second offense. If your second offense occurs outside of five years, along with the previously listed punishments, your jail time could increase to nine months, your vehicle could be impounded for up to 30 days, and an interlock device will be put in your car at your expense. If the second offense occurs within five years of your previous offense, along with the previously listed punishments, you could also face mandatory jail time and the revocation of your driver’s license for a period of five years.

If this is your third offense within 10 years of your last conviction, you will face the previous punishments, but your jail time will increase to a mandatory 30-day stay and a possibility of five years total. In addition, your driver’s license may be revoked for a total of 10 years, your vehicle may be impounded for three months, and your probation may increase up to five years. You may be charged with a felony DUI and you may be ordered to serve your jail time at a residential treatment facility.

Whatever the situation, having an experienced Daytona Beach DUI Attorney on your side is crucial to your defense, and Mr. Miller attends seminars across the state and nation every year to keep himself well versed in the most recent case laws and defenses.
